Responsibilities of the Institution

The activities of the Faroese Board of Appeal are based on the fundamental principle that all individuals are equal and have the same rights under the law. The Faroese Board of Appeal works to ensure that legal decisions are made in a timely manner.

The Faroese Board of Appeal as an Independent Appeals Authority

The Faroese Board of Appeal serves as the appeals authority for administrative decisions made by public authorities, when this is stipulated in law, parliamentary act, or under the authority of such an act.
Once an appeal is received, the Faroese Board of Appeal ensures that the case is fully informed and ready for assessment.

When the case is sufficiently clarified, the Board is composed of the Director and two legal professionals. In special cases, the Director may decide that the Board shall consist of the Director and four legal professionals.

In cases where special expertise is deemed necessary, the Board may be composed of the Director, one or two legal professionals, and one or two relevant subject-matter experts.

The Faroese Board of Appeal as a Decision-Making Authority in Non-Appeal Cases

The Board also handles child protection cases and, among other things, makes decisions regarding the assumption of custody of children and family treatment in state-run institutions.
The basic assumption is that child protection services have fully prepared the cases before submitting them to the Board. The primary task of the Board is then to assess whether there is sufficient basis to follow the recommendation or not, including evaluating whether the available information is adequate for a decision or whether further information is needed.

In the area of coercive measures, the Faroese Board of Appeal assesses whether recommendations for coercive interventions made by municipalities or the Department of Social Services can be approved. The Board also handles appeals concerning the implementation of coercive measures and certain decisions made by the authorities.
