Land and property issues
The Faroese Board of Appeal handles appeals related to land and property issues. This is a broad field and includes decisions concerning, among other things, construction, cadastral registration, land subdivision, and land registration. Individuals, businesses, and in some cases public authorities who, for example, have received a decision from a municipality regarding a construction project or from the Faroese Environment Agency concerning land registration, may appeal such decisions to the Faroese Board of Appeal.
The Faroese Board of Appeal handles appeals concerning:
Decisions by municipalities under the Planning Act or local building regulations
Decisions by the Faroese Environment Agency under the Land Registration Act, the Cadastral Registration Act, and the Land Subdivision Act
Decisions by municipalities under the 1881 Act on expropriation
Decisions under the Condominium Ownership Act
Decisions under the Building Act
Relevant Considerations
An appeal to the Board must generally be submitted in writing and must be reasoned. It is important that the appealed decision is submitted together with all relevant supporting documents. Please also note that the deadline for submitting an appeal is usually 4 weeks from the date the decision is received. In cases concerning expropriation under the 1881 Act, the deadline is 3 months. In special circumstances, the deadline may be extended if valid reasons are provided.
Appeals in land and property issues are free of charge. The aim is always to process the case as quickly as possible, but it can take approximately 5 months before the case is fully prepared and ready for a decision. As the appellant, you will be informed of the progress of the appeal as it develops.

In land and property issues, the Faroese Board of Appeal is typically composed of the Director and two jurists. The Board may seek expert advice during the preparation of the case. In addition, the Board may include one or more subject-matter experts in its proceedings.
