Nature Conservation Issues

The Faroese Board of Appeal handles appeals regarding decisions made by the Environment Agency under the Nature Conservation Act or regulations issued pursuant to the Act. The area is diverse, and the decisions may, for example, concern the capture of animals that live naturally in the wild, the import of live or viable organisms, and the release of organisms that are not naturally found in the Faroe Islands.

Relevant Considerations

An appeal to the Board must generally be submitted in writing and must be reasoned. It is important that the appealed decision is submitted together with all relevant supporting documents. Please also note that the deadline for submitting an appeal is usually 4 weeks from the date the decision is received. 

Appeals in nature conservation issues are free of charge. The aim is always to process the case as quickly as possible, but it can take approximately 6 months before the case is fully prepared and ready for a decision. As the appellant, you will be informed of the progress of the appeal as it develops.

The rules regarding appeals of decisions in nature conservation cases are set out in Parliamentary Act No. 70 of 22 May 2023 on Nature Conservation.

The Faroese Board of Appeal

In nature conservation issues, the Faroese Board of Appeal is typically composed of the Director and two jurists. The Board may seek expert advice during the preparation of the case. In addition, the Board may include one or more subject-matter experts in its proceedings.
